1- GENERAL DESCRIPTION AND DEFINITIONS

Data recording system: A recording system in which personal data is processed by structuring it according to certain criteria,
Contact person: A real person notified by the data controller during registration by the data controller for communication with the Institution regarding the obligations of legal entities resident in Turkey and the representative of the data controller of a legal entity not resident in Turkey in accordance with the Law and secondary regulations to be issued based on this Law,
Personal data storage and destruction policy: The policy on which the data controllers base the deletion, destruction and anonymization of personal data with the process of determining the maximum period required for the purpose for which they are processed.
2- INFORMATION ABOUT THE DATA CONTROLLER
In the case of legal entities, the data controller is the legal entity itself. The data controller obligations of legal entities residing in Turkey within the scope of the Law are fulfilled by the authorized body / person or persons authorized to represent and bind the legal entity. The body authorized to represent a legal entity may appoint one or more persons in relation to the obligations to be fulfilled in terms of the implementation of the Law. This assignment does not eliminate the responsibility of the legal entity in accordance with the provisions of the Law.

7- TRANSFER AND PROTECTION OF PERSONAL DATA
BASS does not transfer the personal data obtained for the purposes of data processing to third parties / institutions without the explicit consent of the relevant person.

8- OBTAINING THE EXPLICIT CONSENT OF THE RELEVANT PERSON FOR THE PROCESSING OF PERSONAL DATA
The personal data to be processed by BASS are processed by obtaining the “explicit consent” of the relevant person within the scope of the Law No. 6698. Explicit consent refers to the consent related to a certain subject, based on being informed and that the person concerned will disclose it of his/her free will. In accordance with Article 5/2 of Law No. 6698, if one of the following conditions exists, personal data may be processed without seeking the explicit consent of the relevant person.
To be clearly stipulated in the laws.
The fact that a person who is unable to disclose his consent due to actual impossibility or whose consent is not legally valid is mandatory for the protection of the life or body integrity of himself or someone else.
It is necessary to process personal data belonging to the parties to the contract, provided that it is directly related to the establishment or performance of a contract.
It is mandatory for the data controller to fulfill his/her legal obligation.
The fact that the relevant person has been publicly identified by him.
The data processing is mandatory for the establishment, use or protection of a right.
It is mandatory to process data for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.
9- DURATION OF STORAGE OF PERSONAL DATA
BASS destroys personal data (deletes, destroys or anonymizes personal data) upon the termination of the purpose of processing personal data, the expiration of mandatory storage periods determined in accordance with Laws and other other legislation.
10- RIGHTS OF THE PERSON CONCERNED

11- APPLICATION TO THE DATA CONTROLLER
Natural persons whose personal data are processed may apply to BASS regarding their requests within the scope of their rights specified in Article 11 of Law No. 6698. Interested persons may benefit from this right provided that they make their applications in Turkish. Interested persons can submit their requests to BASS via one of the following communication channels. In this direction, the relevant persons request;

By means of a secure electronic signature or mobile signature, by using the electronic mail address previously notified to BASS by the person whose personal data is processed and registered in BASS’ system,

For the applications to be made by the relevant persons, the communication channels specified in the section entitled “2-INFORMATION ABOUT THE DATA CONTROLLER” of this information text may be used.
BASS shall finalize the requests contained in the application free of charge as soon as possible and within thirty days at the latest according to the nature of the request. However, if the transaction also requires a cost, a fee may be charged in the amount specified in Article 7 of the “Communiqué on the Procedures and Principles of Application to the Data Controller”. If the application is caused by the error of the data controller, the fee received will be refunded to the relevant person.
12- CHANGES AND UPDATES
